Delivery & Shipping / Production Terms of Die Becherfabrik
1. Scope & Applicability
These Delivery & Shipping / Production Terms apply to all orders of individually designed and printed products by Die Becherfabrik.
Because products are custom-printed according to the customer’s specifications, returns or refunds are excluded.
2. Responsibility for Content & Customer Data
The customer provides print-ready design and layout files. We only check whether the files are technically printable.
We do not review, check or assume any liability for the content, correctness, legality or suitability of the design provided by the customer.
The customer is fully responsible for the content and correctness of the data they submit.
3. Proof / Print Sample (Mock-up) & Approval
If a print sample (“proof”) is agreed upon in the order, we produce and send the sample to the customer within one week.
Final production will exactly correspond to the approved proof — unless the customer explicitly requests deviations.
Production starts only after the customer’s explicit approval of the proof.
4. Production & Manufacture
Production is carried out only after final approval (proof) and — where applicable — after payment.
The production time is determined by the turnaround time specified in the order confirmation.
5. Shipping & Delivery
Small orders / small quantities are shipped via parcel service (standard parcel delivery).
Larger orders / bulk quantities are shipped by freight / shipping company (freight forwarding).
The applicable shipping method and costs will be specified in the order confirmation or invoice.
6. Transfer of Risk & Liability for Transport
For parcel shipments, the risk passes to the customer once the parcel is handed over to the delivery service.
For freight shipments, the risk passes to the customer upon handover to the freight carrier (or their agent), or upon acceptance of the delivery by the customer or their designated recipient.
The customer must inspect goods immediately upon receipt and notify both the carrier and Die Becherfabrik in case of visible damage or losses.
7. Production-Related Variations & Tolerances
Due to the nature of printing and manufacturing processes, minor variations (e.g., in color, cutting, folding, finishing) may occur; such variations do not constitute a defect or grounds for complaint.
Quantity deviations of up to ± 5% are permissible and considered contractually acceptable, especially for large or bulk orders.
8. No Return / No Withdrawal Right
Because the items are custom-made or individually printed to the customer’s specifications, the customer expressly waives any right of return or cancellation.
No refund or exchange is possible — except in the case of a demonstrable, material defect attributable to a fault on our part (see separate warranty / defect clauses).
9. Lead Times & Start of Production
The delivery / production timeframe begins only after the customer’s approval of the proof (if applicable), or after final order confirmation and payment (if required).
Delivery times declared in the order confirmation are indicative; external factors (material supply, logistics, force majeure) may cause delays. We will inform the customer immediately if delays become apparent.
10. No Cancellation / No Rework after Production Start
Once the proof has been approved and production has begun (or final order accepted), cancellation, changes or retraction of the order are no longer possible — unless otherwise agreed beforehand in writing.
We disclaim liability for customer-supplied content that is incorrect, unlawful, or unsuitable. The customer bears all responsibility.
