Right of withdrawal — exclusions

The right of withdrawal does not apply to distance sales contracts for:

• delivery of goods that are not prefabricated and whose manufacture requires an individual selection or determination by the consumer, or that are clearly tailored to the personal needs of the consumer;

• delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene, if their seal was removed after delivery.

The right of withdrawal also does not apply if:

• you are an entrepreneur according to § 14 of the German Civil Code (Bürgerliches Gesetzbuch, BGB) and act in the exercise of your commercial or self-employed activity; or

• we provide you with individual goods or services free of charge.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen (14) days without stating any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods. To exercise your right of withdrawal, you must inform us (Die Becherfabrik, Siegburger Str. 385-387, 51105 Cologne, Germany; Tel.: +49 221 88048620; E-Mail: info@die-becherfabrik.de) by means of a clear statement (e.g. a letter sent by post, or an e-mail) of your decision to withdraw from this contract. Sending the notification before the end of the withdrawal period is sufficient to meet the deadline.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you — including delivery costs (except for additional costs resulting from your choice of a delivery method other than our standard cheapest delivery) — without undue delay and at the latest within fourteen (14) days from the day on which we receive your withdrawal notification. Refunds will be made using the same payment method you used in the original transaction, unless explicitly agreed otherwise; you will not incur any fees for the refund.

We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods — whichever occurs first. You must return or hand over the goods to us without undue delay and in any case no later than fourteen (14) days from the day on which you notified us of the withdrawal. The deadline is met if the goods are dispatched before the fourteen-day period expires. You bear the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss is due to handling beyond what is necessary to examine the nature, properties, and functionality of the goods.

If you requested that services begin during the withdrawal period, you will owe a reasonable amount corresponding to the proportion of the services already provided up to the time at which you informed us of your withdrawal, compared to the total scope of the service contract.
